Privacy policy
WERAX AG (in formation) takes the protection of personal data seriously. This privacy policy explains which personal data we process in connection with our website, enquiries, load-profile analyses, projects, business relationships and communication, for what purposes this is done and what rights data subjects have.
1. Controller
The controller for the data processing is WERAX AG (in formation), Ringstrasse 12, 8600 Dübendorf, Switzerland. You can reach us by email at info@werax-bess.com.
2. Scope
This privacy policy applies to the use of the website www.werax-bess.com, to enquiries via contact forms or email, and to the processing of personal data in connection with the initiation and execution of projects, consulting, load-profile analyses, partnerships and investor conversations. It is governed by the Swiss Data Protection Act (DPA) and, where applicable, the General Data Protection Regulation of the European Union (GDPR).
3. Data we process
- Contact and form data: name, company, role, email address, phone number, address, the content of the enquiry as well as voluntarily provided details.
- Project and analysis data: site, consumption, load-profile, connection, building, charging and operating data, insofar as it is required for an analysis, consultation, engineering, quote, implementation, maintenance or optimisation. Company data may contain personal data, in particular details of contact persons.
- Communication data: the content of emails, phone notes, meetings, submitted documents and other correspondence.
- Contract and business data: quote, order, invoice, payment, delivery, service and documentation data.
- Technical usage data: IP address, date and time of access, pages requested, referrer URL, browser type, operating system, data volume transferred, access status and web-server log files.
4. Purposes of processing
We process personal data in order to provide the website securely and in a user-friendly way, answer enquiries, carry out load-profile analyses and initial assessments, prepare quotes, plan and implement projects, perform contracts, operate or maintain installations, maintain business relationships, comply with legal obligations, safeguard our rights and ensure the security of our systems.
5. Legal bases
Under Swiss data protection law we process personal data in particular insofar as this is necessary to fulfil our tasks and interests and no overriding interests of the data subjects prevent it. Where the GDPR applies, we base the processing, depending on the individual case, on the performance or initiation of a contract, legitimate interests, legal obligations or consent.
6. Contact forms, email and load-profile analysis
When you contact us via a form or by email, we use your details to process the enquiry and for subsequent communication. We use submitted load-profile, consumption or site data to assess technical and economic feasibility, to size battery storage, charging infrastructure or energy-management solutions, and to prepare quotes. Please only send us data that is necessary for the enquiry and that you are entitled to share.
7. Cookies, log files and web fonts
According to its current state, this website uses no tracking or marketing cookies and no web-analytics tool. Server log files may be created for technical operation, in order to deliver the website, analyse faults and prevent misuse. To display the website, Google Fonts are loaded via Google servers. In doing so, your IP address may be transmitted to Google Ireland Limited and, depending on the technical provision, to Google LLC in the USA. The legal basis is our legitimate interest in a consistent and performant website. If the fonts are hosted locally in the future, this external transmission for Google Fonts will no longer apply.
8. Recipients and processors
Personal data may be passed on to service providers and partners insofar as this is necessary for the purposes mentioned. These include in particular hosting and IT service providers, email and communication providers, planning, installation, service and project partners, manufacturers, grid or metering service providers, advisors, banks, insurers, authorities as well as legal and fiduciary service providers. Processors are appropriately obliged to process personal data only on our instructions and with suitable security measures. Personal data is not sold.
9. Disclosure abroad
We process personal data mainly in Switzerland and the European Economic Area. A transfer to other states may take place if service providers, manufacturers or communication providers operate systems there. If disclosure occurs to countries without an adequate level of data protection, we use appropriate safeguards, in particular recognised standard contractual clauses, or rely on statutory exceptions where permitted.
10. Retention period
We retain personal data only as long as necessary for the respective purposes, as long as statutory retention obligations exist, or as long as there are legitimate interests in documentation and the enforcement of rights. We generally retain business and contract documents for the statutory retention periods. Server log data is generally deleted or anonymised after 90 days at the latest, unless longer retention is required to investigate faults, security incidents or misuse.
11. Data security
We take appropriate technical and organisational measures to protect personal data against loss, misuse, unauthorised access, alteration and disclosure. These include in particular transport encryption via HTTPS, access restrictions, careful selection of service providers and organisational protective measures when handling project and communication data.
12. Rights of data subjects
Within the limits of applicable law, data subjects have the right to information about the personal data processed, to rectification of incorrect data, to erasure, to restriction of processing, to object to certain processing and, where applicable, to data portability. Any consent given can be withdrawn with effect for the future. To exercise your rights, contact us at info@werax-bess.com. We may request appropriate proof of identity to process the request.
13. Right to lodge a complaint
Data subjects can lodge a complaint with a competent data protection supervisory authority. In Switzerland this is the Federal Data Protection and Information Commissioner (FDPIC). Where the GDPR applies, a competent data protection authority in the EU or EEA may also be contacted.
14. Changes to this privacy policy
We may adapt this privacy policy at any time, in particular if we change our data processing or new legal requirements apply. The version published on the website at any given time applies.
